Integrity and Packaging (on)

In order to safeguard China’s socialist market economic order, prevent unfair competition, protect the legitimate rights and interests of consumers, and promote the spirit of good faith, China has successively promulgated a series of laws and regulations concerning the marking of product packaging in the past ten years, such as the “exports of the People’s Republic of China in 1992”. Rules of Origin, Law of the People's Republic of China Against Unfair Competition of 1993, General Criteria for the Labeling of Food Packaging, 1994, Provisions on Investigating and Violating the Labeling of Food Packaging Labels, 1995, Regulations for Labeling Product Marks, 1997, 1998 The "Regulations on the Supervision of Quantitative Packaged Goods Measurement", the "Provisions on the Protection of Geographical Products in China" issued in 1999, the "Notice on Cracking down on the Production and Sale of Counterfeit and Commodity Products" in 2000, the "New Trademark Law" in 2001, and the "New Drug Administration Law" The Measures for the Administration of China's Famous Brand Products, the Measures for the Supervision and Inspection of Commodity Quality, and the recently implemented "Regulations for the Labeling of Pharmaceutical Packaging Labels" and other laws and regulations aim at ensuring the credibility of product packaging from the source of production and maintaining the socialist market economic order. Better alignment with WTO rules.
On the International Consumer Rights Day on March 15th this year, the relevant authorities of the country announced four major categories of packaging hams and children's clothing produced by 81 companies in Beijing, Tianjin, Shanghai and other 10 provinces and markets. As for the results of the product quality inspections of all varieties, the overall pass rate was only 41%, and the pass rate of packaged ham was 57.1%. In addition, according to the Beijing Municipal Quality Supervision Department, large-scale inspections were conducted on prepackaged goods (ie, quantitatively packaged goods) sold by major supermarkets and shops in the capital, such as fruits, vegetables, and food. The results showed that the quantity of goods for quantitative packaging was severe and the net content was qualified. The rate is only 78.9%, which is obviously lower than the national qualification rate standard for the “Quantity Packaged Commodity Measurement Regulations”. The phenomenon that the weight of goods and packages is commonly measured together, resulting in a lower qualified rate of quantitative packaged goods. "Liuyi" children's day before the National Quality Inspection Department announced the children's products: infant formula milk powder, flannel toys qualified rate of only 65.8% and 68.1%, the thickness of bags does not meet the standard.
Another manifestation of product packaging labeling that does not focus on good faith is to exaggerate the word to the public, or to flash its words and deeds. This is especially the case with pharmaceutical packaging and nutritional packaging. What are the "national new drugs," "protected varieties of Chinese medicine," "imported raw materials, packaging," "honorable exports," "winning products," "excellent brand new," "modern technology products," or "completely free of preservatives," etc. And so on, the proliferation of gorgeous packaging often mislead consumers and even cause adverse consequences.
Food packaging labeling Food packaging labeling is a major issue related to personal health and life safety. On June 20, 1995, pursuant to the "Product Quality Law of the People's Republic of China," China issued the "Regulations on Investigating and Violating the Labeling of Food (Packaging) Labels" (hereinafter referred to as "provisions"), and this packaging work should be given special attention and practice.
(1) The "Regulations" expressly provide that all labels of prepackaged foods (ie quantitatively packaged goods) produced or sold within the territory of the People's Republic of China must comply with the mandatory national standards "General Standard for Food Standards (GB7718/94)" and " The provisions of the standards for beverage wine labels (GB10344) and the label of “Special Nutrition Food Labels (GB12432)”, and the prepackaged food products whose food packaging labels do not meet the above requirements cannot be manufactured and sold.
(2) If the labels of prepackaged foods for quantitatively packaged foods have the following unqualified items, they shall be corrected within a time limit; if they do not correct within a specified time limit, they shall be ordered to stop production, sales or fines:
1 The food label shall be marked without any indication of quality grade, product standard number, irradiated food (food that has been treated with ionizing radiation or ionized energy);
2 The items marked on the food label are complete but do not meet the four basic principles stipulated in the General Standard for Food Labeling;
3 The food label does not meet one of the six basic requirements specified in the General Standard for Food Labeling. (To be continued)
